Message: THEY TOLD US THAT OUR REFI ON 2 PROPERTIES WOULD CLOSE IN 1.5 WEEKS. THE UNDERWRITER TOLD US THAT WE DID NOT NEED TO MAKE A MTG PAYMENT. 3.5 WEEKS LATER, AFTER BEING IGNORED, WE WERE DENIED DUE TO MY HUSBAND WOORKING FOR THE GOV AND THE INABILITY TO DIRECTLY CONTACT HIS EMPLOYER. THEY HAD BEEN SENT 20 YRS OF PAYCHECK STUBS. WE THAN WERE MARKED AS BEING LATE 60 DAYS ON A PAYMENT, OUR CREDIT SCORE DROPPED, AND THEY REFUSE TO HELP WITH ANY PAYMENT ARRANGEMENTS.TODAY I RECEIVE A LETTER STATING THAT OUR NEXT MTG PAYMENT WILL BE PUT INTO A FUND FOR CURRENT AND FUTURE LATE FEES.

Message: I worked for Countrywide for about a year and left in August, 2005. In 2005 Countrywide decided to stop paying employees current and start paying them one week in arrears. They gave employees what they called a "Cutover Loan" which would cover the one week's salary the employee would be missing in their paycheck because of Countrywide's policy change. Subsequently, the employee would pay Countrywide back the "Cutover Loan" through paycheck deductions. When I quit Countrywide in August, 2005 I was sent a final paycheck that was suppose to cover the money I was owed for vacation I handn't taken and days I hadn't been paid for yet minus whatever amount I still owed on the "Cutover Loan." Now, a year and a half later I just received a collection letter from Countrywide saying that I owe them $332.18 from the "Cutover Loan" from 2005. I doubt that I still have any paystubs that I could use to verify the accuracy of what they are saying. Is this legal for them to send me a final payoff check and then send me a letter a year and a half later saying tha5t they are attempting to collect a debt I owe them?

we were in hurricane katrina. my house was almost a totaled. me job had gotten blown away by the storm. counrty wide said that 3 months house notes would be defered to the end of my loan. now the call and say that is not true and they expect me to make up the payments now. i asked if they recorded phone calls and he replied yes some of them they do.. iasked if he could find the conversation i hade when they said my loan was defered and he almost choked and said he didnt know if that was possible. but i bet if it was in thier favor they could find the recorded phone conversation. is there anything that we can do??

These stories are numerous. CFC's servicing profits TRIPLED last quarter, even though loan sales are significantly lower! From what I understand, CFC has an invitation to a Homeland Security hearing in DC, in the near future, for abusing hurricane victims with this pattern of behavior. Homeland Security has had to foot the bill, while CFC reaped the benefits of (reportedly) illegal servicing fees on their loans. You can read, all over this site (look at other states), about consumers and employees alike, devastated by the greed and immorality of this company. The prosecuting attorney in your area may also take an interest in these types of business practices. This is a good place to find others like you. And the more hits there are to this site, the easier it will be for others to find. Do your research and speak up!! The heat is on CFC right now and they are freaking out.

I have a similar story that matches what most of you have been saying about payments not being posted and the harrassing phone calls. I purchased my home in December 2004. First of all CHL messed up my property tax escrow costing me over $1,000.00. I work for the attorney who conducted my closing and I submitted all the figures to the lender. CHL did not use the correct figure for the tax bill and therefore the incorrect amount was escrowed each month. In December 2005 I received a statement for CHL stating that my escrow was in the negative and they wanted me to send them a check for the $1,000 +. I'm a single working mom that reveives no child support, tell me where that big lump some is going to come from. I called the company to find out where the problem may have accured. They put it off on the closing attorney. I told them that NO it wasn't due to them because I was the person who handled the closing and I gave you all the correct fees. They still insisted that I messed up. So it turns out that they increased my monthly payments by over $100.00 each month to make up for their mistake in which I have to pay for the next 12 months. I also took out a Home Equity Line of Credit at the same time as my mortgage and I have been receiving harrassing phone calls at night stating that I haven't been making my payments and they want to know if I'll make my payment over the phone. I've told them that ALL my bills are current and that I'm NOT late on their payment. I had to stop in the middle of preparing supper to dig out my check book and look up the last 4 months of payments. I had to take my stuff of the stove and I got my list together of my payments, check numbers, check amount and issue dates. I have this to the CHL person and they found that two payments where posted to my first mortgage and they had NO record of the other two. A few nights later I receive another call form CHL telling me that I late on my payments and asking me when I plan on making my payment. I go through the whole they again with them. I'm still getting my monthly statments stating that I'm a month bedind on my payments. I'll never use CHL again nor recommend anyone to them. In my line of work I have dealt with CHL in closing loans for lots of people in my area and most all of the dealings I've had with them over the phone have not been very professional. They have been rude and non-caring about the borrowers needs or concerns.

We have been totally screwed over by Countrywide. After the storm (Hurricane Katrina) we applied for a hiatus on payments. Mistake!!!!!!! We are now in foreclosure even though the hiatus was approved by our wonderful lender and no late fees or missed payment fee of any kind would apply according to Countrywide. Now we are past due, not on Sept, Oct & Nov. the months we were approved for. We are late on April May and June. The payments we are making now are applied to past months and the current months are being reported as past due as they are not the months we applied for the hiatus on. Mot once have we received a bill that didn't have some kind of fee on it and when we call which is every month, no one can tell us what the fees are for. We signed a paper stating the missed payments would be applied to the end of hte loan and received a loan modification statement saying the amount would be added to the top and we would end up paying interest on interst owed and already paid. WE ARE GETTING SCREWED ROYALLY BY COUNTRYWIDE!!!! Can anyone help? What are our rights?

You don't seem to get it.

For many years Countrywide HAS BEEN #1 in customer service. But guess what? Countrywide is soon to be a HAS BEEN.

I know all this because I had just recently quit Countrywide to work for another mortgage company.

Countrywide didn't use move operations over to India, BUT NOW they do! That will be bad for customer service.

COUNTYWIDE IS NOW TOO CHEAP TO KEEP UP ON ITS COMPUTERS AND COMPUTER SYSTEMS. When I worked there, computers froze up at least 5 times a day, and application information was always getting erased.

That is why the number of customers complaining about missing payments has been increasing in the last few years.

That is why it is now taking Countrywide 30 to 40 days to close a loan. Also because Countrywide now has a lot of untrained, inefficient, and disorganized underwriters and processors. (Countrywide may now also be too cheap to hire an adequate staff)

That is also why payoffs and other items are now coming out wrong.

That is also what led up to the poor and incompetitent handling of Shela's situation.

Also Countrywide requires just about all of its loan originations to use LANDSAFE appraisal, a company owned by Countrywide itself. Their appraisals are extremely conservative, and 9 out of 10 of mine and other A/E’s came in OVER $10K less than comps. Even if the home was in good condition. This forces the A/E to restructure the loan a higher rate, less cashout, fewer bills paid, or a some combination of the factors. Their appraisals set the road for disguised predatory lending, and bait and switch.

Wake up Joe D! Have you ever studied the life cycle of an organization? Check it out. It comes in four stages: Introduction, growth, maturity, and decline. Right now, Countrywide is slowing down in the growth stage about to hit maturity. The only thing holding right now is the brand name its built from its past. And if Countrywide continues with its path, it will not be long until it is in its decline stage.

ENRON WAS ONCE A FORTUNE 500 COMPANY. Countrywide is riding in the same path.

Also Countrywide was recently sued in California from its conduct as an employer, and apparently it never learned from the lawsuit. Another lawsuit will happen.

Joe D. you are not in the position to call the people here "Jerk Offs". Especially if you're another goon in Countrywide's management. Because only someone in CW management would stick up for Countrywide the way you just did.

Not to meantion Joe, you posted your same pathetic post on all 50 state pages here, claiming to be from different local cities.

Countrywide Home Loans received my insurance check on October 23, 2005. I FedEx'd it for the record, telling them I wanted to pay off my loan. My home was completely destroyed. I desparately needed the money.They cashed the check on November 30, 2005. They managed to find the address for the rental I moved to after the storm. They began sending me Mortgage payments. I called each time, telling them that they had my check. They did not send the balance of my money back to me until January 18, 2006. THEN THEY REPORTED ME TO THE CREDIT BUREAU AS A LATE PAY ON MY MORTGAGE LOAN! THEY HAVE RUINED MY CREDIT, AND I AM HAVING TO FIGHT TO GET MY CREDIT BACK FOR SOMETHING I DIDN'T EVEN DO. These people are evil, and heartless. By the way, they did not pay me the interest they collected on my money.

COuntrywide had a lender's placed flood insurance policy on my home, for $184,000. They placed it with thier in house insurance company Balboa Insurance. After Katrina put ten feet of water in my living room, I returned to New Orleans and was determined to rebuild. I knew it would take a few months to get the adjuster out, and get my insurance check, but hey, I was covered, and I had a contract saying they would pay to replace my home.

So I started work. I had some money put aside, and thought, 'Hey I can start the work with my savings, then when I get my check I can replace what I spent.'

This was the stupidest thing I have ever done.

The Adjuster came out and said I only had $74,000 worth of damages. My $200,000 home was completely destroyed and they thought I could fix it for 74g. Anyone who read the adjusters report can tell he was an Idiot. (I now know all the Countrywide employees are idiots) The report payed for some things, like light switches, but fail to pay for the electrical box the switch goes in, the wire that connects the switch, the circuit breaker the wire conects to, or the electrician that is gonna do the work. According to them I can rewire a 2,800 sqft house for about a thousand bucks. (Actual cost? $27,000)

This is just one example in the report. There were many other. Then Countrywide said they weren't going to send a new adjuster.

At this point in the renovation, I had completed about 25% of the work done on the building. So countrywide, decided to release 25% of the money they had collected. The problem being, 25% of a $200,000 renovation, is not 25% of $74,000. The refused to release the rest of the money they had of mine, insisting that I do more work first.
IT is at this point I sued them.

During the Lawsuit, they started calling and harassing me for payments. I explained that they had almost $50,000 of mine, and I was suing for $109,000 more. I explained that if they would like to release my money I would be more than happy to make payments, but until that time they could jump in a lake.

I spend six months trying to explain to these people that I cannot do any more work until they give me my money, they say they can't give me money till I do the work. All the time I'm getting deeper in debt to them because they haven't waved any payments or interest.

Seven months later, after the case is moved to federal court, they send a new adjuster. The second adjuster's finding? I get all the money I was insured for. But It took seven months and a lawsuit to have them come look at the property again.

I really think that my blow up point has just about exploded, At this minute they are convincing me to continue, what can they do to make it right. I told them to get the figures corrected. You see, I have had 3 notories out for 3 different closings. If I continue, it will be the 4th closing. I have been told by several departments that whatever question I was asking wasn't handled by them. It was always somebody elses job to handle, but I would always end up in a circle. One example, I was quoted (after the first and 2nd fiasco) 2-1/4 pts with --%rate, when notary came that evening, the pts showed 2.625 pts, In my world that's alot of money that I could use. then after speaking with them the following day. They were going to "waive" the pts to the 2-1/4. I asked them how could the waive something that was never there. He should be correcting his mistake or whoever's mistake. Besides not getting to speak with someone during the day and the evening no one is working, How do they ever get paperwork done?
I would suggest when closing with CountryWide, you be sure to write names, phone numbers, quotes, everything down with times and dates. I have witnesses so it wouldn't hurt if you could.
If they can record phone conversations for "better service", then I feel like that would be the thing to do when working with countrywide. If I go thru the next closing, it will be the 4th. Will see.
Every day has been a disaster when talking with them. supervisors and all. Then to get at closing and have different figures, Surprise, Surprise, Surprise, I'm glad it's the weekend.

It's amazing (but not suprising) to see so many people with so many of the same problems we're having with CountryWide. We can't seem to get anyone to give us the paperwork that we need to figure out where the problem is in our escrows for 2 mortgages we have with them. One of them, I'm sure, they've been collecting over-inflated escrow payments for a while now, that I'm driving myself insane trying to figure out. When this is all finished, I expect that they will owe us thousands of dollars in overpayments. We have been calling since November, 2005 (this time) and we've gotten nowhere. All I want is a printout of my payments from start of loan. One in 1998 and one in 2003. We were told by our insurance agent that 2 of 3 of their calls and complaints are concerning Countrywide. Her advise to us was, "Find another mortgage company!"

Countrywide appears to have a policy of non-discrimination when it comes to screwing people. The Louisiana Attorney General has put Countrywide in the crosshairs for what could easily be construed as embezzlement by small-minded people.

Our loan was sold to Countrywide in 2002. We have been in a running battle since the beginning. First, they added "forced placement" coverage and then charged our escrow account - even after we repeatedly mailed them copies of the current policy.

When we tried to get a copy of "their" policy we were told we could not have a copy.

18-months ago we suffered about $40,000 in damage to our property after two back-to-back storms sheared trees in the front yard and rearranged our roof.

We had to make immediate and eventually permanent repairs to the roof structure and porch. Countrywide, it turns out, is the owner of the so-called "insurance companies" it uses for forced placement coverage: Newport and Balboa.

After all of that, we had to file bankruptcy. Countrywide never disputed the payoff ($80,000) or the amount owed us on the insurance claims ($39,000) with the bankruptcy court.

What they did do is, literally, pocket the funds.

CHL telephone reps were always able to confirm the claims but were locked out of their own computers when they tried to determine where the funds had been sent.

James-Hoyer law firm in Tampa has a class-action suit underway for folks that have been screwed by these "forced placement" scams that Countrywide is running.

To add insult to injury, after defrauding us with a "forced placement" policy, CHL's reaction when we tried to get the funds from them? They kept the insurance proceeds and doubled our premium.

Now surely J.D. Powers has an award Countrywide can "buy" for that little stunt, right?

SURVIVING KATRINA WAS EASY, COMPARED TO DEALING WITH COUNTRYWIDE:

When I recieved the insurance check in Oct 05, it took four extended calls TO CHL, asking for specifics of how the releases would be made, before someone mentioned as an aside that I had the option to use the money to pay off the mortgage. I didn't trust them with the largest check I'd ever seen in my 55 years of life.

Only five calls later, to get the proper address, I sent the payoff via certified mail. That was on Oct 28th.

I had been promised repeatedly that CHL would register the paid mortgage with the parish and send me a copy; and that subsequently within 30 days, CHL would send me title to my house.

In January, I called to inquire about progress and was told that the registration had been returned because the survey was missing. If I had not called, it would have sat at CHL forever. So they reconveyed the paid mortgage to the parish, which was received and registered on Feb 2nd.

But when I called CHL on Mar 10th, they knew nothing about it. It was only when I called the Clerk of Courts office that I found out my mortgage lien had been registered on Feb 2nd. Now (Mar 22nd) Countrywide refuses to send me anything but a letter stating when they sent the registration application.

I've had to contact the Clerk's office to obtain it, so I can sell the house. Also CHL states that there is no title in Louisiana. So why did three different people in October state that CHL would send me title to my house?

Previously they had paid an insurance statement with the bold "THIS IS NOT A BILL" and put my escrow almost $1,000 in debt. I had already paid the insurance for the year directly.

Every time I call I get the agent du jour--even with a "direct number and extension" I still get thrown into the customer service call center. Each earnestly tells me something different from the last. And the Property Claims Dept does not talk to Customer Service; and Reconveyance talks to NO ONE!

When I buy a house in Texas I will go a long way to not do business with these bozos again. The only side Countrywide is on, is their own.

I am also getting severely jerked around by Countrywide. Insurance check for $33K plus was made out to myself and CW, which included $8K to crane the trees out of my roof after Katrina. Have spent an additional $18K plus getting framing and roofing repairs, and CW has only sent me an initial $15K draw. Have filed a formal complaint with La. A/G office, don't know if that will help anything. If anyone knows of a class action against these a-holes, please let me know; I don't care if I don't net a dime out of it, but want to join just to screw with them. They seem to think the insurance money is theirs, not ours. Freakin' unbelievable that they can do this.

We are Katrina victims and just like everone else Countrywide has over $90,000 of our insurance money. We have done everything they have asked of us, we pay our mortgage on time, we have faxed the insurance appraiser's report, etc. Yet they will not send us our insurance money to repair our house. Everytime we call we get the run around. We are lucky we have a very fair inspector and she submits her inspection reports same day, but it doesn't help because they continue to keep our money. One stall tactic after another. It appears this company can steal your money and get away with it.

My wife and I are only a few years into our 30 yr mortgage. Our mortgage was brokered and CWL had the best rates. Last year we decided to check into combining a couple of smaller personal debts into a CW HEL...that was a headache for about 4 months. We finally contacted the loan "person" and told them to forget it! Every time we called it seemed we had to explain the case over and over...like there was no case# to reference..Anyway, we decided there are a lot of other institutions out there who would be glad to help with employees who are capable of good service...I was a little surprised at the $2.00 monthly fee CWL charges us to draft our note pmt., but after the horror stories I've read about payment posting problems, I don't mind the fee as much...just hope i can get through the next 20 years or so...

We have a Countrywide Mortgage. We live in Louisiana and had damage from Katrina. After fighting with Travelers Ins. We recieved our check made out to us and Countrywide. They asked us to send it to them FEDEx and we would recieve a percent of it within 10 buisness days. After a 1 1\2 months we still had not recieved our funds to repair our home. We were already over $10,000 out of pocket. They sent our first check 8 weeks after they recieved it. We requested a inspection to recieve more funds over a month ago and still have yet to hear back from them.

On the 15th a Countrywide Supervisor guarnteed me that a inspector would contact me within 48hrs.

Again I believed them and waited for the call that never came.

I called Countrywide back and was told first that they did not even show a request and that it would be at least another 3 to 5 buisness days (just like I was told on Jan 5th )

All we want is the money to finish repairing our home and an HONEST reply to the situation that they have put us in. Our savings are drained paying for repairs while Countrywide is sitting on our insurance funds collecting interest on our misfortune.



We honor the terms of our contract and pay our payment on time every month.

Countrywide should also follow the terms of the contract .

I've talked to many people regarding their home situation in New Orleans and it breaks my heart to hear the horrible stories from people about how Countrywide will not give them the money they deserve on their properties and once that is settled, they can't even get the funds in full but in incremements. Countrywide is sweat shop to work with and all they care about is their money and not people. I tell you that there is a company who cares and I love them, and that is Wachovia. Check them out and see how their different. They care about their customers and will go that extra mile. I worked for Countrywide, there horrible and then looked into Wachovia and they are so different. Great Products, great Company. When I got my loan with CWHL, this was about the only mortage company that would help. Boy have they helped. If they did receive my payment by the 3rd of each month, my phone would start. They would want me to make payment by check or wire it. How many times do you have to tell them that the payment is coming and that your are suppose to have a 10 day grace period. For every day I was late past the 3rd I would be charged almost $9.00 a day plus a late fee until they receive the payment. The first of this year I sold this property. When I called to find out about the paid in full kit, they keep telling me that they have been mailed. As of yet I have not received. Then about the middle of January I received a escrow check. I have no checking account, but my parents have a account with my name on it, so I went to that bank and cashed the check. Simple huh!!! The first of February my dad called and asked me if I had cashed a check in this amount. I told him yes. It seems that CWHL put a stop payment on the check. Needless to say this amount was deducted from my parents account plus the bank fee. I call CWHL and ask what the problem was. It seems that they had made an error and were sending me a correct check. I receive no letter, or call concerning this matter,and told them there seems to be a problem somewhere and it wasn't on my end. They had to have prove showing it was deducted from the account. Had to fax it to two different numbers before it got to the so called right person. Said they would get back with me on Monday. Yea right!! I called and I was told that they were sending a check for the fee charge, but that was all they would do. So for their ------ --, I am out over a hundred I have to pay my parents. Their error but whose getting the screws?

So, if anyone every ask me about CWHL, they may get a ear full, be ready cause none of it will be good.

It seems that a lot of people are angry at Countrywide (and maybe rightfully so) but before passing judgement some fact should be cleared up:

1) countrywide is not earning interest off of the funds that they hold from your insurance checks. the money sits on your account as somewhat of a credit to the loan (not in a countrywide bank account). if they really were i'd be pretty ashamed, but in the midst of what is already bad press i somehow doubt they would do something that stupid which could easily leak out to the media.

2) "it takes forever to get an inspector out to my property"- i know, it does. unfortunately there's just a shortage of inspectors in the area. but they are actively trying to get more poeple out there.

3) it's not Countrywides decision as to what the guidelines are to endorse your insurance check. unfortunately there are investor requirements which limit how much we can endorse, after a certain amount checks must be sent in for endorsement.
* note - the investor is the private third party that funded your loan, every loan has one. government investors (fannie mae, freddie mac, ginnie mae) are easy to work with but private investors (Deutche Bank, Bank of New York, etc) have more limitations. countrywide only services your loan. it's your investment, and the investors as well - hence the precautionary meausres in the endorsement of the checks. if the investors just let us endorse every check lots of people would more than likely just walk away from the property and start over elsewhere - which is bad news for the investors, and the city.

4) finally, be nice to the people in the servicing centers helping with the insurance checks. it's all stricly volunteer. no one has to go out there, and to date countrywide is the only mortgage company actually sending people out there. no one gets paid extra to go. most people go because they want to be able to say they helped and did what they could. if you have a problem try stopping by and have someone help you face to face. be polite, but firm. the people there for the most part are really interested in helping you.

i know the experience changed my perspective of things. i didn't really fully understand until i got home the extent of the disaster, and the impact it made on so many lives. i hope this information helps clears things up, and if it doesn't then i don't know what else to say other than i'm sorry...

hello cyberspace,

my wife and i have been going back and forth with countrywide mortgage since the hurricane. every day with this company becomes a new adventure and a different lie.
i am a police officer down here in louisiana and i thought that i had a hard time dealing with the situations just after the storm, boy i proved that wrong.i get the first part of an insurance check, mailed it to counrtywide and the joke begins there.
my wife and i have spent over 15,000.00 dollars out of our own money to get things started. now on the other hand countrywide has just mailed out the first part of our insurance money to help us out $5000.00, while the rest of the money sits in counrtywide's bank gaining interest. somethings wrong with that picture.
please avoid dealing with the national branch of countrywide, they do not know there ass from a whole in the wall. contact your local branch, this has proved to be a little bit better, hell thats how i got the $5000.00
in the event that someone reads this statement and is aware of an active law suit against counrtywide for this type of shady dealings, please email me at rs40966@yahoo.com so that i can get on board.

They have refused to release funds to us in spite of the fact that me and my husband has coughed up more than $15,000 of our own assets just to get started on repairs. Do not make your monthly payments at the local Countrywide branch. It will end up with a 30 day late on your credit report even though their company had receipt of your payment. Overnight mail or pay online if you are getting to the end of the month.
SUCKS but that's the way it is.

If you have a countrywide line of credit forget accessing it after a disaster until your home is re-inspected for completeness. Best bet is to draw all the funds out and put them in your bank and then repay your credit line when you have your house put back together. If you dont do this you wont have access to your credit line money to help fix up your house.

VISIT your local countrywide branch, ( do not mail ), and have the branch manager sign/endorse the check. you can then deposit the insurance check directly into your personal check/save account. i would deal w/the local countrywide branch. i would NOT deal with the national 1-800 customer service line. you will be lost in the shuffle. remember that the insurance money is just as much yours as it is the lenders. good luck.

Hurricane Victims Being Victimized

My family and I are victims of hurricane Rita and thought that once the storm passed and cleanup had started, that the worst was behind us. Although some had difficulties collecting insurance, our claim was processed with no problem and was adequate to pay for all damages.

When we received the insurance check, it was made out to us and the mortgage company Countrywide Finance. We contacted Countrywide and they told us to simply send the check and it would be returned to us in four to five business days. After they received the check, they deposited it in their account and informed us that we would only receive a portion of the amount with a cap of $15,000 no matter how much damage we or anyone else had and would take four to five weeks to receive. The remainder would not be paid to us until ALL work had been completed and inspected by their inspector. The representative told us the repair costs beyond the $15,000 initial distribution would have to be paid by us until all work was completed. We were forced to pay for all damages from our savings.

To my surprise and outrage, this practice is apparently legal and practiced by some large and uncaring financial institutions. If the victim is unable to financially pay for the repairs, the victim would have no choice but to let lender foreclose on the property. I have attached an article from South Florida’s Sun-Sentinel newspaper that explains the practice in more detail.

I am asking for legislation to allow the victims to use their insurance money to make repairs.

BATON ROUGE, La. (AP) — The state attorney general's office is investigating a California-based mortgage company following complaints that the firm has taken too long to release insurance money meant for Louisiana residents whose homes were damaged by hurricanes.

The company, Countrywide Home Loans Inc., issued a statement acknowledging the delays but blaming them on the high volume of insurance claim checks required after Hurricanes Katrina and Rita. The number of checks overwhelmed the company's system, the statement said.

"This created unfortunate and unusual delays to some of our customers for a period of several weeks," the company said.

Over a dozen formal complaints have been filed with Attorney General Charles Foti's office, alleging that Countrywide has received insurance money meant for homeowners needing to repair their homes, but held on to the cash for an unreasonable amount of time, Foti spokeswoman Kris Wartelle said.

Many such insurance checks require a signature both from the homeowner and the mortgage company before the homeowner can receive the cash. One Louisiana homeowner told investigators that Worldwide held his $111,000 in insurance payments for more than a month, forcing him to produce $50,000 to pay contractors repairing his storm-damaged home, Wartelle said.

The Countrywide statement said the company has caught up with the flow of checks, which "are now being processed in a timely manner."


Countrywide is a subsidiary of Calabasas, Calif.-based Countrywide Financial Corp.

My story is bizarre. On December 2, 2005, I sent them an overnight package including 4 checks (3 from insurance companies) and a cashier's check from my bank for the payoff. The letter clearly stated that I wanted the loan paid off effective the date of their receipt and that I would be tracking the package to make sure they paid off the loan. I've been arguing with them for nearly 3 weeks now since my loan still shows a $220k balance even though I sent them the payoff. I'm working with a specific representative over there who has been pleasant if not yet effective. Apparently Countrywide decided to issue me a check for $12,000 so I could begin repairs on my home. Funny thing is, they must have forgotten that I sent them $44k of my own money to PAY OFF THE LOAN. So I asked how this was even possible with the letter attached to the checks, and I was told that apparently with the volume of checks, the proper oversight hasn't been given to individual loans. Then beyond that, they assured me my loan will be paid off effective December 6th, 2005 (even though I will demand that it's paid off effective December 3 - and I have the FED EX tracking message to prove it).

We'll see if they can get anything done tomorrow. Apparently a "manager" who can "get things done" is now involved. I'm not holding my breath, but I can't help myself every time I talk to them in telling them, "Why would I want to pay you $1,800 a month to be my escrow agent when I can do the work myself?!"

After waiting 3 weeks for the check, I was told that they would send me $5K as was the amount determined by the investors who evidently hold my loan. This check was turned over to countrywide on the 4th of November. 17 days later, I still don't have any funds. I have spent over 12 grand of my own money starting the repairs. Each time I call countrywide to find out where is the first draw, I am told a different lie. Today is the third day that someone from the "office of the president" has promised to wire the funds. None yet. What is countrywide doing with all of the insurance money? My home sat in 5 feet of water for almost 3 weeks after Hurricane Katrina. After I visited my home for the first time, I could not believe the destruction. All the contents were destroyed and mold was everywhere. After I filed a flood claim on my home I discovered that my $200,000 home was insured for only $33,000 on the dwelling and $0 for the contents. I phoned my insurance agent (after finding who my agent was) and found that Countrywide did not pay my insurance premium from my escrow account for this year. The agent told me that he sent 3 notices to Countrywide and got no responses. He said he then mailed me a notice and got no response so he canceled the policy. When I called Countrywide I was told that since I did not pay the premium, they placed the $33,000 policy on the property. I reminded them that they were in charge of my escrow account and that they did not pay the premiums after 3 notices from the insurance agent. They informed me that it is my responsibility to keep my insurance policies up to date. Since then I have been given the run-around every time I call. I have no idea of why they would do such a thing since a balance of over $100,000 remains on the mortgage.

I lost my home in Hurricane Katrina. Immediately after the storm, I contacted Countrywide and was told we could freeze the loan for 90 days and have those payments added to the end of the term. I called back again a week later to confirm that information and they assured me that Countrywide wanted to help us bla bla bla.

Two months later I received an insurance settlement for less than what I owe on the property. We want to rebuild, but it will be some time before the city is issueing permits and we're able to get all of the plans/contractors lined up. The insurance check is made out out to me and Countrywide jointly. They have "generously" offered to hold my $250K settlement in an account while I continue to make payments on the $300K loan. So, I'm paying them interest on $300K (we just bought this house in January) while they hold $250K of MY money in a non-interest bearing account. That amounts to about $1000 a month in interest.

I spoke with several customer service agents by phone and visited two offices to try and get this straight, because I really couldn't believe they would take advantage in this way. In the meantime I'm lining up a way to refinance the difference between my settlement and the loan so I can get rid of this mortgage.

Yesterday I got a call from Countrywide asking why they hadn't received payments since August. Somehow, the minimum of SIX people I have talked to there about our situation is not showing up on the file. He asks that I send them a copy of the letter they sent me confirming that I had requested a freeze on the loan. There is NO MAIL SERVICE to my zip code yet so I could not have received such a letter, and their system won't allow them to enter another address to use for correspondence. On top of it all, this agent tells me that after the 90 days, we will be expected to make those three payments in full, not move them to the end of the loan.

What they don't seem to realize is that my house is worth less than the loan right now, and I can't live in it. My only reason not to let them foreclose is an interest in saving my credit rating. If they're going to report me for late payments anyway, I don't have even that reason anymore. Congrats Countrywide, you're buying yourself a worthless property in the middle of the country's biggest environmental disaster in history. Good luck finding a buyer.

Two homes with Countrywide at this time, never again. As we are in the disaster area of hurricane Katrina I called all creditors and received payment suspension for a month or two until things resume. When I called Countrywide they said sure they could help and this is what we can do as our part to help. We will also suspend your payments for up to 90 days and then you can PAY THEM ALL AT ONE TIME at the end of the 90 days. SOME HELP. I HOPE THAT ANYONE THAT CONSIDERS COUNTRYWIDE TAKE THIS INFO INTO CONSIDERATION, you never know when you to will be in a disater area. Account # 42391111.

I don't know about all the name calling, etc. but one thing is certain. Something bad has happened to Countrywide in Atlanta and there won't be an end until it's destroyed. Someone hired people to run this part of the company that either have no interest in the company or just simply aren't qualified to run a company. There is no profit being made and everyone is unhappy -- customers and employees. Seems like a recipe for disaster. Sit back and watch it fall. Maybe a year, maybe not that long. They'll be gone, someone new will be along or they can close down Atlanta altogether. I don't think Atlanta would be missed by the rest of Countrywide.

You need to stay on top of your credit. You need to request, through Equifax, your credit report be updated and corrected. It's an error. Instead of doing something rash, like refinancing 3 months after you just refi'd, fix the problem. How much more money did you waste on your second refi? I'll bet you're paying out off your ass with a high rate too. It's not too smart to just run away from your problems. You might want to face them in the future.

I have been with Countrywide since September of 2004, I was never late on one payment. In July of 2005 we tried to finance something and they told us that Countrywide turned us over to Equifax saying that our payment was 120 days late. Then they said that in October of 2004 it was 90 days late, our first note was not even due until November of 2004. When we called to find out what was going on they said that there computer had a glitch and it turned thousand of there customers over to Equifax. Needless to say they did nothing to help us clear our name. I refinanced in August and got away from them.

I'm going to post this in every state listed here. YOU MUST TAKE RESPONSIBILITY FOR YOUR OWN ACTIONS AND DECISIONS!! I have recently left the lending industry. I can site many reasons for this, however the top reason has to be dealing with borrowers and potential borrowers who had no concept of financial responsibility. Just because you have a 700 credit score does not mean you demonstrate good use of credit or that you are guaranteed the rate or terms you want. In fact, many people who have the best credit scores carry the most debt. What you people do not understand is that the lending institutions want you to carry debt, so if you carry alot of debt and pay it on time your score will be higher than someone who pays their bills OFF every month and only carries a mortgage and a car loan/lease. If you fall on hard times, pay your damn mortgage and let the friggin' Visa's go delinquent. Visa isn't going to take your house, your mortgage company is. People jump to quickly to file BK. Guess what, ole' GW has made that next to impossible for the average American. You're better off making arrangements with your credit card companies and paying your mortgage off as quickly as possible. Use good judgement, not the "I want it now!" mentality. Buy a Trailblazer instead of the RangeRover or the Hummer or the Lincol or Caddy or whatever. How many of you people that post on here have kids? Thank you so much for this website. Our realtor recommended Countrywide so strongly that we went to them for our mortgage. If you think Countrywide is bad, try going to a realtor who works hand-in-hand with Countrywide. Countrywide gave us an interest rate upon which we based our offer. As soon as the offer was accepted, Countrywide upped the interest rate so much that we knew we could no longer afford the house, but we had signed an offer to purchase that allowed that rate of interest (on the advice of Countrywide, who said it didn't really mean we would ever have to pay that higher rate, it was just something to put on the offer). So, we went to a bank, and they offered us a much lower rate. The bank called the realtor to start the loan process. The realtor turned around and called Countrywide, who then called us, to offer us a much, much better rate. Okay. But then, Countrywide wouldn't move. Not even an application to start the loan process. Each time I called they tap-danced about computers and "in the system," etc. We had no application, no written estimate, nothing. Twelve days before closing I called our local bank in a panic. They were able to do the loan at that interest rate and cut Countrywide out completely. They said if we had waited a couple more days it would have been too late. We believe that Countrywide was holding out until we had no other options before they would give us a loan, and the terms of it would have been at their pleasure.
THEN, we found out our realtor had not disclosed an encroachment. This alone could have been a deal-breaker, but we wanted the property so we worked out a deal with the man who owned the property on whom we were encroaching. We also got an attorney, and asked him to take over the closing, which we had been planning to do at the realtor's office. WELLLLLL---Here it gets fun. Countrywide and our realtor had worked into the purchase all sorts of "creative financing," so that we, the buyers, would be credited with approximately $3,500 at the closing, which would have been at the realtor's office, where we wouldn't have known what the hell he was doing with the money. But our lawyer and our bank did exactly that; they credited us with the $3,500. In fact, they ran out of places to credit us, so the seller ended up writing us a personal check for the balance. Our realtor was shocked when he found this out at closing. We had to stay an hour while everyone in his office and the lawyer's office looked for money, calculators clicking, pages flying. The realtor went outside and talked on his cell phone. We overhead him shout, "Well then we're screwed!" I kid you not! At another point in this comedy our lawyer asked him, "Well, where's the earnest money? I don't have it. Do you have it?" And the realtor said, distractedly, "Well yes, I have it, but…." and went back to playing with his calculator.
The way it finally turned out for us was beautiful. The seller actually ended up paying for part of our down payment, but it didn't cost him anything because Countrywide had him raise the asking price in order to credit us, in order to be able to get their thousands at closing. We paid NO FEES whatsoever, and walked away with a small check to the good. The seller paid a very low commission to the realtor (because the realtor quoted him a small commission, apparently because he, the realtor, was going to get a cut of the "creative financing" done by Countrywide at closing.) Watching this comedy of errors was truly enjoyable; however, it followed a month of anxiety and fear. I don't recommend Countrywide to anyone. And if your realtor recommends them, please be warned.

We refinanced with Countrywide in 2003 and the title company said we were not in a flood zone. We closed and everything was fine and then in 2004 we get a letter from countrywide saying that our was now in a flood zone and we had to get flood insurance. I called several times asking for documentation to show the rezoning of my property which they never provided. They then forced placed flood insurance adn charged me $695 and now they are saying my payment is going up. We went to the city government planning and zoning commission which wrote a letter and attached a fema map which stated we were not in a flood zone. Countrywide says the only way they will remnove it is for us to file this 15 page application with fema which takes 90 to 180 days to process. THey suck and dont ever do business with them

I am amazed at the stories I have seen here. I too am a customer of CountryWide. I have for nearly two years been enrolled in the payplan/26. According to the mailer, this plan is to ALLOW YOU TO BUILD EQUITY IN YOUR HOME FASTER. Well, I did not realize exactly what was going on until I went online to check the status of my account. You see, I contracted with these people for this plan which automatically debts my checking account every two weeks for a fee of $2.00 per transaction. Well I figured, because of my background in banking and loan processing, that when my payment was received by CountryWide - they would of course, take the interest that was due and whatever belonged to escrow and apply the rest to my principal. This is normally how it works - or should work. Well I found through my internet statement that my payments when received were being held in Partial/Balance. This means that CountryWide was taking my money from my account, charging me to do so, and holding the money for 4 weeks - or until the whole amount was gotten then applied. I called an asked if this was indeed the case - and how was that supposed to have saved me money or added to equity. The answer was - the extra payment at the end of the YEAR. I said Yes, I understand that, BUT YOU ARE TAKING MY MONEY AND HOLDING IT AND CHARGING ME BESIDES. I COULD HAVE JUST SENT AND EXTA PAYMENT ON MY OWN. What if I had an interest bearing checking acount. I would be loosing money on both ends, by them debting my account and charging me besides. AM I THE ONLY ONE who has expierenced this phase of their operation. Or has any one else really noticed. Thank you for letting me sound off. I still have not clarified this situation as of yet, but I have stopped the drafts and still looking for an answer as to what can be done!!

I cannot believe the amount of stories I read on your website of shear consumer ignorance. I've had a harder time with Chase Manhattan than with Countrywide. It took them 7 years and my attorney sending a letter to them before they reported my mortgage paid in full with the credit bureau. I've enjoyed working with Countrywide and would recommend and do business with them any day. Our broker was kind, up front and let us choose our appraiser and monies paid in excess were refunded to us at closing. I think more of these consumer complaints stem from people NOT being proactive in the type of care they receive. If you are being wronged, then go to the top because all of the branches are independantly owned. I'm positive if the corporate headquarters knew of discrepancies or problems with any of the branches, that they would take care of it, even if it took you a few hundred dollars to get an attorney to submit a letter of reprimand. No fair complaining if you aren't willing to fix the problem!

I am a first-time home-buyer, and I am utterly disgusted by Countrywide. My real estate agent says that in his 25 years of practice he has never seen such incompentence on the part of a mortgage lender. For starters, Countrywide simply refused to return phone calls. My girlfriend had to literally stand in the office and stare down the processor to get a good faith estimate that they had promised us for weeks. The miscommunication within the office was mind-bogglingly pathetic. Faxes of important financial documents were received one day and lost the next. Our closing date was perpetually delayed. Finally, on the day before the latest closing was to happen, we were told to prepare a certified check for a down payment of $11,700. OK, fine. But the very next morning -- the supposed day of closing, mind you -- we suddenly were given a figure of almost $1,000 more! "Must have been a mistake," the processor said, pointing fingers elsewhere but refusing to personally apologize. Well, it's a little tough to come up with $1,000 in several hours. And we still haven't closed. Because of Countrywide's incompetence, we missed out on closing during the 2004 tax year. Well, we've had it. Here's a New Year's resolution: We will be finding another lender in 2005 ... one that knows how to conduct business professionally. This has been a nightmare for us. Please stay away from Countrywide.
